BrownGreer PLC Selected as Directing Administrator

The Enforcement Committee, Settling Distributors, and Janssen have selected BrownGreer PLC as the Directing Administrator for the Distributor and Janssen National Opioid Settlements.

BrownGreer PLC was selected after targeted competitive solicitation processes. They were chosen for their experience successfully handling large, multi-year settlements, their ability to take on the proposed work, and their competitive pricing proposals. They have provided claims administration and related services since 2002. They have in-house expertise in all aspects of the Directing Administrator work, including understanding complex agreements, developing and implementing allocation methodologies, and communicating with and paying beneficiaries.

As Directing Administrator, BrownGreer PLC will be the primary point of contact for states and subdivisions. BrownGreer has begun coordinating with states and anticipates the first payment (from the Distributor Settlement) to local governments in some states will occur by the end of May. Because of the steps that need to be completed for payments to be made, payments to local governments in other states may take several months. Among other things, it depends on the timing of state courts entering consent judgments, whether states are able to provide BrownGreer agreed-upon allocation amounts or need BrownGreer to calculate the allocations, which under the national agreement’s terms requires local governments to receive notice 50 days before payments can be made, and provision of payment instructions by subdivisions. Payments will be made on a rolling basis as states and subdivisions become ready for payment.

BrownGreer PLC has set up a Communications Center with a team of Case Managers who will work directly with the state and local governments receiving money. Thousands of U.S. communities to receive opioid recovery funds from $26 billion global settlements as soon as May 2022.

Over 90% of litigating local governments have confirmed participation in the global settlements approved today by the “Big Three” drug distributors AmerisourceBergen, Cardinal Health, and McKesson, along with opioid manufacturer Johnson & Johnson.

On Wednesday, July 21, 2021, the National Prescription Opiate Litigation MDL Plaintiffs’ Executive Committee, several State Attorneys General, and four major defendants announced agreement on terms of proposed nationwide settlements to resolve all Opioids litigation brought by states and local political subdivisions against the three largest pharmaceutical distributors: McKesson, Cardinal Health and AmerisourceBergen (“Distributors”), and manufacturer Janssen Pharmaceuticals, Inc. and its parent company Johnson & Johnson (collectively, “J&J”).  These settlements, if agreed and adopted, will provide substantial funds to states and subdivisions for abatement of the Opioids epidemic across the country and will impose transformative changes in the way the settling defendants conduct their business.

This website provides copies of the agreements, as well as additional documents and information concerning these historic proposed settlements.  The agreements themselves control the terms of the settlements and entities eligible to participate in the settlements should consult with counsel about participation.
